1. Who we are
These Terms and Conditions ("Terms") are between you and Connoisseur Foods LLC, a California limited liability company doing business as SirGeon's Caviar ("SirGeon's," "we," "us," "our").

These Terms govern your use of sirgeonscaviar.co (the "Site") and any purchase you make from us. By using the Site or placing an order, you agree to them. If you don't agree, please don't use the Site or order from us.
Our Privacy Policy, Refund Policy and Shipping Policy are incorporated into these Terms by reference. Where a conflict exists between these Terms and any other page on the Site, these Terms govern.
2. Eligibility
You must be at least 18 years old and able to enter into a binding contract to order from us. By ordering, you confirm that you are.
We sell only within the contiguous United States. We do not currently ship to Alaska, Hawaii, US territories including Puerto Rico, PO Boxes, or any address outside the United States.
3. Orders
Placing an order. Your order is an offer to buy. We accept it when we send you an order confirmation. Until then, no contract exists between us.
We may decline an order. We can refuse or cancel any order, in whole or in part, including where the product is unavailable, where we cannot ship to the address given, where we suspect fraud or resale, where an error has occurred in price or product information, or where we cannot verify the information you provided. If we cancel an order you have paid for, we will refund it in full.
Order changes and cancellation. Because we ship perishable goods on a short fulfilment cycle, orders cannot be changed or cancelled once placed. Please check your shipping address and delivery date before you confirm. If you spot an address error, contact us immediately — we will try to help if the order has not been dispatched, but we cannot guarantee it.
Accuracy of your information. You agree to give us current, complete and accurate purchase and account information. We are not responsible for delays, losses, failed deliveries or additional carrier charges arising from an incorrect or incomplete address you supplied.
4. Prices and payment
Prices are in US dollars and exclude shipping and applicable taxes, which are shown at checkout.
Prices are subject to change without notice, though a change will not affect an order we have already confirmed.
We may correct pricing or product errors and cancel affected orders, including after an order is placed, with a full refund.
Payment is processed by Shopify and its payment providers. We do not store your card details. By submitting payment information you confirm you are authorised to use the payment method.
5. Shipping and delivery
We ship overnight within the contiguous United States. Delivery dates selected at checkout are estimates based on carrier service commitments and are not guaranteed.
Once your order is with the carrier, its schedule is not within our control. Weather, carrier operations and other events outside our control may affect transit times. We are not liable for losses arising from a delay in transit, including a missed occasion.
Risk of loss. Title and risk of loss pass to you when we hand the order to the carrier. Any replacement or refund we provide after that point is offered at our discretion under Section 6, and providing one in a given case does not create an obligation to do so in another.
Delivery failures we cannot cover. We cannot replace or refund orders affected by an incorrect address you supplied, a refused shipment, a package forwarded or rerouted at your request, a carrier hold, or a delivery that could not be completed because no one was available to receive it.
Receiving your order. Caviar is perishable. Please bring the package indoors promptly and refrigerate the tin on arrival. Cold packs are expected to have partly thawed in transit; this is normal, and the product is fine if the tin is cold to the touch.
6. Perishable goods, returns and replacements
All sales are final. Because caviar is perishable and leaves our cold chain on dispatch, we cannot accept returns or exchanges.
Quality concerns. If you open a tin and believe the product is not as it should be, contact us within 24 hours of opening and we will review it individually.
We may decline a claim where the packaging has been discarded before contact, where the delivery failure falls within Section 5, or where we reasonably believe the product was mishandled after delivery.
7. Food safety and product information
Our caviar is fresh, unpasteurised sturgeon roe. It contains fish.
Because it is raw and unpasteurised, it may not be suitable for people who are pregnant, immunocompromised, elderly, very young, or otherwise advised to avoid raw fish products. Consuming raw or undercooked fish may increase the risk of foodborne illness. If you have any doubt, speak to a healthcare professional. Nothing on the Site is medical or dietary advice.
You are responsible for storing the product as directed and for consuming it within the periods stated on the tin and on the Site.
Product descriptions, images and nutritional statements are provided in good faith and for general information. Natural variation between harvests means colour, size and flavour will vary between tins.
8. Regulatory compliance
All sturgeon species are protected under CITES. Our product is imported and sold in compliance with applicable CITES requirements and US law, and every tin carries a non-reusable CITES label.
You may not resell, re-export, or commercially redistribute product purchased from this Site without our written permission. Orders that appear to be placed for resale may be limited or refused. For wholesale enquiries, contact hello@sirgeonscaviar.co.
9. Site use
You may use the Site for lawful personal purposes only. You may not use it to break any law, infringe anyone's rights, upload malicious code, scrape or harvest data, interfere with its security or operation, or misrepresent your identity.
We may refuse service, terminate accounts, or cancel orders at our discretion.
10. Intellectual property
All content on the Site — text, copy, photography, illustration, design, the SirGeon character, and our trade marks and logos — belongs to us or our licensors and is protected by intellectual property law. You may not reproduce, distribute or create derivative works from it without our written permission.
Anything you send us. If you send us ideas, suggestions, reviews, photographs or other material, you grant us a non-exclusive, royalty-free, perpetual, worldwide licence to use, reproduce and publish it. We are not obliged to keep it confidential, pay for it, or respond to it. You confirm the material is yours to send and does not infringe anyone else's rights.
11. Third-party links and services
The Site may link to or rely on third parties, including our payment processor and carrier. We are not responsible for their content, policies or performance. Complaints about a third-party product or service should go to that third party.
12. Disclaimers
Except as expressly stated in these Terms, and to the fullest extent permitted by law, the Site and everything on it are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Site will be uninterrupted, secure or error-free, or that any information on it is complete or current.
Nothing in these Terms excludes or limits any right you have that cannot be excluded or limited under California or federal law.
13. Limitation of liability
To the fullest extent permitted by law, Connoisseur Foods LLC, its members, officers, employees, agents and suppliers will not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for lost profits, lost revenue, or loss of data, arising out of or connected with your use of the Site or any product purchased from it, even if we have been advised of the possibility.
Our total liability for any claim arising out of or connected with these Terms or any product will not exceed the amount you paid for the order giving rise to the claim.
Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.
14. Indemnity
You agree to indemnify and hold harmless Connoisseur Foods LLC and its members, officers, employees and agents from any claim, demand, loss or expense, including reasonable legal fees, arising from your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.
15. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute will be brought in the state or federal courts located in LA County, California, and you consent to their jurisdiction.
16. General
Severability. If any provision is held unenforceable, the rest remains in force.
No waiver. If we don't enforce a provision, that isn't a waiver of it.
Entire agreement. These Terms, together with the policies referenced in Section 1, are the entire agreement between us.
Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition or sale of assets.
Force majeure. We are not liable for failure or delay caused by events outside our reasonable control.
Changes. We may update these Terms by posting a revised version with a new date. Changes apply to orders placed after posting. Your continued use of the Site means you accept the current version.
